The impact of repealing legislation: the role of local authorities in education

The juxtaposition at the recent ADES conference of Mike Russell, Cabinet Secretary for Education in Scotland, and Steve Munby, Chief Executive of the English National College for School Leaders, provided an interesting perspective into the possibilities for the future of Scottish education.

Mr Russell was very careful not to give away anything about changes to the governance of schools post local elections scheduled for May 2012. However, the general consensus is that change is on the horizon and that it will see more devolution of power to schools and headteachers; a change to funding mechanisms to schools and the associated role for local authorities; and an associated change to the role of local authorities in setting policy.

No-one reckons that there will be wholesale changes along the lines that were experienced in 1995 when the most recent local government reorganisation took place. Primarily due to the fact that any externally driven change requires the government to pick up the tab for the change process, etc.

This is where a comparison between what has happened in England over the last 25 years or so can prove useful. I must emphasise that I do not think Scotland will follow the English model in terms of the final outcome, e.g Academies, Trust schools, etc, but rather that we might follow the change strategy.

For it seems to me that one of the main means adopted in England has actually depended more upon repealing legislation, as opposed to the starting point being the creation of new legislation. That’s not to say that new legislation won’t be necessary but that the starting point could be to consider which pillars of the existing system could be pulled away, which in themselves might lead to radical change.

This is certainly what happened in England in the 1988 Education Reform Act, which saw a range of powers for Local Authorities being removed and either passed down to schools and their governors, or passed upwards to the government. Over the next 23 years those twin directions of travel have been inexorable. This is most recently evidenced in the 2011 Education Act, which further repealed the duties of local authorities.

In that period the government have not had to legislate for change in the organisational structure in local authorities, but rather by changing the responsibilities of local authorities the government created an environment where the local authorities had to adapt themselves to their changing role.

So what might be the duties currently undertaken by Scottish local authorities which, if removed, might lead to the most significant change?

To my mind there are four duties outlined in the “Standards in Scotland’s Schools etc. Act 2000“, which, if removed, might result in dramatic change to the education system in Scotland.

The first of these duties relates to the role of the local authority in relation to school improvement. This would be a fundamental shift in practice and would transform at a stroke the role of the local authority.

Section 3

(2)An education authority shall endeavour to secure improvement in the quality of school education which is provided in the schools managed by them; and they shall exercise their functions in relation to such provision with a view to raising standards of education.

The second duty which could be removed might be in relation to the local authority’s role in determining educational objectives for schools in their area.

Section 5

Education authority’s annual statement of improvement objectives

(1)For the purposes of their duty under section 3(2) of this Act, an education authority, after consulting such bodies as appear to the authority to be representative of teachers and parents within their area and of persons, other than teachers, who are employed in schools within that area and after giving children, young persons and such other persons within that area as appear to the authority to have an interest in the matter an opportunity to make their views known, shall, by such date in 2001 as the Scottish Ministers may, after consulting the education authorities, determine (one date being so determined for all the authorities) and thereafter by that date annually, prepare and publish a statement setting objectives.

The third associated duty which could be removed might be in relation to school development planning, which would remove the obligation of the school to take account of the local authorities statement of educational objectives. (although this would be superfluous if section 5 (1) were removed.

Section 6
School development plans

(a)a development plan which takes account of the objectives in the authority’s annual statement of education improvement objectives published by that date in the year in question and sets objectives for the school;

Finally, the last duty which could be removed might be in relation to the delegation of budgets to schools. This presupposes that the delegation scheme is devised by the authority. However, if this were removed it could be replaced by a national scheme of delegation which is simply overseen by the authority.

Section 8

Delegation schemes

(1)An education authority shall have a scheme for delegating to the headteacher of a school—

(a)managed by them; and

(b)of a category of school which is stated in the scheme to be covered by the scheme,
management of that share of the authority’s budget for a financial year which is available for allocation to individual schools and is appropriated for the school; or management of part of that share.

    Of course, these are simply personal musings on the future of local governance of education and are not based in any inside knowledge of what will happen once the local elections have taken place. Nevertheless, it’s important for people in my position to have some view of how the things might change and how we could adapt if these were to come pass.

Overcoming curriculum inertia: a zero based approach

Arguably the most difficult stage to implement significant curricular change is in the senior phase of secondary education.

The “high stakes” nature of the upper secondary school assessment system combines with other factors, such as self interest, fear of change, rigid staffing and timetabling models, and avoidance of potential conflict to create a state of “curriculum inertia” which is incredibly difficult to shift.

There is no blame to be attached to this inertia. It is a natural consequence of a system which has laid down sedimentary layers of practice, structures and expectations one upon the other, from one generation to the next – regardless of changes to examination arrangements.

In my recent post on senior phase options I listed a number of possibilities, which, if combined, could radically change the way in which we meet the needs of senior students. Yet regardless of how good these ideas might be, curricular inertia will make it incredibly difficult to see any more than a few translated into practice and certainly not enough to reach a tipping point in favour of the needs of the student – as opposed to the needs of the system.

The orthodox approach to senior phase curriculum planning has been to adopt an incremental approach where tweaks are made from one year to the next but which in reality result in minimal and cyclical change.

An alternative approach to be considered is borrowed from the world of financial budgeting – Zero based budgeting:

“Zero-based budgeting is an approach to planning and decision-making which reverses the working process of traditional budgeting. In traditional incremental budgeting, departmental managers justify only variances versus past years, based on the assumption that the “baseline” is automatically approved. By contrast, in zero-based budgeting, every line item of the budget must be approved, rather than only changes.[1] During the review process, no reference is made to the previous level of expenditure. Zero-based budgeting requires the budget request be re-evaluated thoroughly, starting from the zero-based”

Zero based curriculum planning adopts similar a similar philosophy i.e.schools start the planning process from scratch based around the needs of students and build from that point, with no reference to what was done before.

Of course, this would be an enormous change for schools and the reality is that we ARE limited by the staffing profiles which have evolved to suit our existing curricular models, even if they don’t facilitate the needs of young people.

Nevertheless, I reckon that by adopting at least some elements of zero based curriculum planning we can begin to envisage a model of delivery which is very different from what we have today. It is only by describing that vision that we can begin to plan a coherent change strategy to translate that into practice.

Community Ownership of Schools

 

I’ve been approached by quite a few people over the last couple of weeks about our ideas relating to Community Ownership of Schools.

I thought it might help to gather together in one place a number of related posts which provide an insight into the evolution of this idea and the underpinning rationale.

The first point to emphasise is that we are encouraged by our elected members to “think out of the box” in relation to policy development in East Lothian.  The following links track the development of an idea which is not yet fully formed nor planned to Nth degree.  In that respect I have been adopting the role of the leader as a sculptor:

“The alternative to the technically focused leader’s vision is to see vision as an outcome which is not ‘set’ from the beginning. Instead the sculptor has an idea; a notion; a picture in mind – e.g. to create a sculpture of a human form – but as the sculptor commences work the final outcome may be very different from what they had in mind at the beginning but is all the more successful for that variation.

What the sculptor is doing is to constantly check on the quality of the developing work. By checking it against a desire to produce the “best” work possible the sculptor shifts the vision rather than carrying on working towards something that will not be as high a quality as what will be created through a more flexible approach towards the final outcome.”

Accumulating Credit for Learning

One of the conclusions I’ve gradually come to over the years is that in order to facilitate real change in any system it’s necessary to change the landscape.  It’s come to me slowly and for all that I believe that focusing upon cultural change is still fundamentally the correct route to improvement – I’ve also come to recognise that we just tinker at the edges if we are asking teachers to change their practice within a system where the fundamental features remain static. 

So when it comes to a Curriculum for Excellence I fear that little will change unless we shift some of the key building blocks upon which our practice is based, e.g. how we give credit for learning; how we organise learning, and how we deliver learning. 

My thinking on this has been influenced by a recent trip to New Zealand where I encountered their qualifications system. Much like our Scottish Credit and Qualifications Framework (SCQF) their system is based upon levels and associated credits for learning.  However, there are two important features of their system, which appear to have an advantage of our Scottish version.  Firstly, their levels and credits equate exactly with university entrance requirements, whereas SCQF has to be translated into UCAS points; and secondly, they differentiate outcome by a simple system of Pass, Merit and Excellence in any unit of study. A New Zealand student needs 80 credits to gain a National Certificate of Educational Achievement (NCEA) at any level.  That certificate can be endorsed with “Merit” if 50 of these points are achieved with “Merit” and likewise for the student who gains 50 points or more with “Excellence”.

It was while this was fresh in my mind that I recently visited Jewel and Esk College of Further Education with a group of our secondary Headteachers and senior staff. In something of a damascene moment I began to see how we might begin to change the landscape for organising and delivering learning in our schools and the example has been under our nose for a number of years now – you don’t even have to go to the other side of the world!

One of the understandable strategic elements of the Curriculum for Excellence implementation process has been to try to keep the qualifications issue separate from the curriculum development – as it was feared that the focus of secondary teachers would always swing to what was going to be tested and ignore some of the more fundamental questions about the experiences and outcomes of the courses they taught.  However, with hindsight this may have been a mistake as it denies the reality of secondary education and its links to access to employment and further and higher education. 

The other lesson to be learned from our New Zealand cousins and, more pertinently, from our colleagues in further and higher education – is how to trust internal assessment.  I’ve written before how colleges in Scotland can give credit for learning up to Higher National Diploma (which is a couple of notches beyond Advanced Higher level) without having to rely upon any form of external assessment) – while schools continue to have to rely heavily upon external assessment – at levels of learning significantly below HND.

So how might we use this knowledge to create a framework within which our schools can innovate, develop practice and improve the outcomes for learners? Perhaps we could create a common assessment and accreditation that could overlay the curricular model being developed in our schools?

Imagine a scenario where each relevant unit of work taught in S1 – S3 carried a credit for numeracy, literacy, health and well-being – and skills for work, i.e. all those experiences and outcomes that are the responsibility of all teachers. By creating a matrix of learning experiences learners could, through moderated internal assessment, which builds upon formative assessment strategies, be awarded credits at a range of levels of learning with outcome being recognised through Pass, Merit and Excellence. As these credits are accumulated the learner could achieve a local Certificate of Achievement that could be endorsed with Merit or Excellence. By the end of S3 a learner will have undertaken a broad education and will also have a record of their achievements in these crucial building blocks for learning.

Such a system would provide teachers with a clear framework; yet enable them to create innovative and challenging learning contexts where these outcomes can be achieved. Some schools may create units of study which fill identified gaps in provision, which may not sit clearly with a single subject domain.

Finally, such a system would enable students to become familiar with the likely curricular structure and national accreditation model, which they will encounter, in the senior phase of learning and beyond school in further and higher education.

University Challenge

 

I’ve just had a very positive meeting with some senior colleagues from Queen Margaret University. The new QMU  has just been built in East Lothian and has been named as one of the top 10 modern universities by the Sunday Times Good University GuideIt’s mission statement reads as follows:

To enhance the quality of life and serve communities, through excellence and leadership in vocationally and professionally relevant education, research and consultancy, as a university which is outward looking and committed to innovation, participation and lifelong learning.

In line with that exciting ambition we discussed the possibilities for partnership and soon recognised that the scope was huge and that what we have at present requires greater coordination and strategic direction.

Here are some of the possibilities:

1. Continuing Professional Development for education staff in East Lothian Council through the University’s Centre for Academic Practice and MSc in Prof Ed.

2. Sharing QMU’s  Learning and Teaching strategy to help to develop independent learners by end of S3.

3. Delivery of QMU part-time learning in EL Schools.

4. Creation of virtual and not-so-virtual learning environments for S6 students.

5. Sharing of kit & equipment e.g. chemistry labs.

6. Joint appointments or secondments.

7. Specific projects in areas such as performing arts especially drama, dance, film-making & theatre.

8. Shared utilisation of space in capital projects.

9. Research evidence for ELC meeting single outcome agreement , eg in health.

10. Engaging with the “Curriculum for Excellence” and “More Choices, More Chances” agendas.

We are already planning an exciting conference to be held at the campus scheduled for June 2009 which will involve every new S6 pupil in East Lothian but this just goes to show the incredible potential which exists for partnership events which will benefit both the university and the community of East Lothian.

 Our next step is to organise a high level strategic meeting to examine other partnership opportunities across the Council, beyond education, and to select a small number of initiatives to take forwards in a productive and coherent manner.

 Other suggestions are very welcome.

Solution Focused Budget Planning

The challenge of providing a high quality education service at a time when expenditure is growing faster than the available budget means that change, in some form, must take place.

There is a tendency in education to always reflect upon such an issue from the moral high-ground and simply state that more money must be forthcoming! As the person who is charged with responsibility for a budget of nearly £85 million to deliver education and children’s services for 15,000 children in East Lothian it’s a topic which is constantly at the forefront of my mind.

One of the key factors in managing such a budget is to ensure that everything is absolutely transparent. In East Lothian we have spent a huge amount of time and effort in “opening up” our books – there are no black holes, no smoke or mirrors, no hidden funds. What you see is what we get. When such information is treated as confidential it only goes to feed the suspicion that some groups are being treated more favourably than others.  When everyone can see the entire “pot” it becomes very clear that an increase in one area in education must be subsidised from another area within education.

It was with this in mind that we had our first meeting of a Strategic Finance Group for Education. The group has union representatives from  the EIS, HAS, AHDS, Unison, SSSTA; three parent representatives from East Lothian Parents’ Councils; three senior elected members; three members of the Education Department management team (including me); and a Finance Department Representative. I had hoped to get a couple of pupil representatives – but perhaps next time.

The group spent all morning reviewing the available budget for the coming two years (2009-2010/2010-2011); identifying and discussing possible areas where savings could be made; and planning for our next meeting.  The traditional approach to this process is for management to sit in a darkened room – consider the options, present these options to the administration and then implement them across the authority. This alternative approach turns this on its head by involving the stakeholders at the outset of the process and ensuring that there are no sacred cows such as central services which cannot be offered up for savings. The meeting was exceptionally enlightening as we approached each suggestion with true professionalism and objectivity. As stated earlier we have to make savings if we are to work within our available budget – the challenge is where these savings might be made. By involving those who are closest to the “chalk-face” we begin to build up a picture of how we might work together to ensure that any negative impact upon children is minimised.

The ideas which flowed from the meeting will be followed up over the next three months by firstly identifying the amount of money that can be saved by each option and an associated impact assessment for each option.  When we reconvene after the summer we will have produced a list with quantitative and qualitative impacts – this list will then be further considered by the group to identify preferences and recommendations which can then be considered by the administration. The bottom-line -as I reinforced yesterday – is that nothing is off the table in terms of making savings.

One of the key points to emerge was that the process is not as simple as it might seem.  Although some areas seem ripe for savings the knock-on impact they have beyond the immediately obvious makes it all the more important that the stakeholders present on the group have an opportunity to have their say.

School Based Management 1

I’m attending the Association of Directors of Social Work conference in Crieff.

One the key themes emerging is that of personalisation of services to users. The social work field is light years ahead of education in terms of using a mixed economy system for delivering services, by commissioning others from the private and voluntary sector to provide a wide range of short and laong term requirements.

As I was listening to the presentations my mind turned to how education might develop such a model.  It’s been something I’ve been considering for a while but the cogs seemed to click together this morning.

The starting point for this is how do we really devolve services to our communities?

What follows is definitely “blue sky” and might be disconcerting for some but I’ve found that sometimes we need to start from the extreme perspective if we are to shift our ground.

The local authority would set the local outcomes which schools would have to work towards.

Each child would carry an educational value credit which directly related to money which would go to the school. All other current budgets would be rolled together and added to the educational value credit.

If a child left the school the money would follow them – even part way through a year.

The school would deliver – though a contract – the educational service for the local authority in that community.  If the outcomes were not achieved in a given period of time then another service deliverer would have to be employed.

The school would purchase services from the local authority – or other providers e.g. finance support, personnel, staff development and even quality improvement and assurance.

The authority would maintain responsibility for strategic estate planning, such a new school buildings but all other items would be devolved.

Schools in a community could combine their resources to purchase a service from elsewhere.

The pupil support function could also be delivered by a independent unit commissioned by the authority and underpinned by a contract arrangement.

Parents would have a significant role in the strategic direction and monitoring of the school and would be involved in the review of outcomes at the end of a contract period. 

I know one of the major concerns would be the fragmentation of the current system which is building very vibrant learning communities where schools work together. However, if we believe that partnership working improves outcomes – and outcomes will be used to judge the effectiveness of a school – then the leverage for it to happen will be even greater than it currently is. In a similar way the need to engage with other agencies would be built into the outcome agreement.

Using outcome agreements for school improvement

 

I came across the concept of a social return on investment last summer when Jim Honan explained the Program Logic Model.

The model seeks to find a way in which public services can actually have a greater impact by focusing upon the things that will actually lead to a return on social investment.  The tendency in education has often been to focus on outputs or activity and to only try to work out the outcome – or success criteria – at the end of the planning process, i.e. there are a legion of initievies and activities which have been implemented in Scottish education which have not had any discernible positive impact.

The model flips this on its head by forcing the service to consider the impact that we wish to have as the starting point for action. I’ve explored this in a number of previous posts but this week we sent out our Service Improvement Framework which schools will use to guide their activity for the coming year.

The Framework tries to make a link with the Council’s corporate plan and priorities but the pages which schools will undoubtedly focus upon are pages 8 and 9 – which set out the outcomes which we will use to judge the level of return we are getting from the investment in education in East Lothian, i.e. £75 million.

Borrowing from the Scottish Government’s concordat with Local Authorities we intend to give much greater flexibility to schools and clusters as to how they will go about achieving these outcomes – what works in one school or community won’t necessarily work in another school or community.

I know how positively I would have responded to such an approach, or as  one head teacher said to me this week – “trust us and we’ll do the business”.

Solution Focused Planning

 

The power of our strategic groups came to the fore this week at our 3 -18 Strategic Learning and Teaching Group.

This group has 25 members who represent a wide cross-section of those of us involved in education in East Lothian.  I know its accepted logic that such a large group can’t operate successfully but it’s the very size of, and representation within the group that actually makes it effective.

We started the meeting reflecting upon the impact of our Learning and Teaching policy in the last year.  By splitting up into groups of 3 we were able to identify a wide range of observable changes in our practice throughout the authority that would evidence our emphasis on learning and teaching.

The second part of the meeting was given over to considering our Service Improvement Plan for the coming session. I showed the group a range of the possible outcomes which we have been exploring.  One of the draft outcomes read as follows:

“All children will achieve Level B in reading by the end of P4, level D by the end of P7, and Level E by the end of S2.”

We discussed the thinking behind this desired outcome and the reaction it might stimulate amongst teachers. The problem lay in the notion of “All” and the idea it just seems to reaffirm a focus on attainment – which many teachers just see as a means of keeping the Authority and HMIe happy – as opposed to helping individual children learn.

I’ve written so many plans for departments, schools and authorities now that I’ve become acutely aware of the dissonance between what the writer of the plan might intend and the perception of the plan by those who have to implement it.

The idea behind the outcome is that we would like every child to be able to read by the age of 9 – at least well enough that their reading ability does not limit their progress in any other area of the curriculum. As we wrestled with the problem of how we might come up with an outcome which was clear, kept our focus on reading, but didn’t antagonise teachers we struck upon a solution. That solution was to take the problem to the teachers – let them know what we wanted to achieve, why it was important, and  some guidance on the characteristics of an outcome – and let them come up with the answer.

The power of this idea is that has so many advantages:

  1. It engages teachers with the rationale of the outcome approach;
  2. It will enable us to generate an agreed outcome which has a wide range of stakeholder ownership;
  3. It will enable us to have the impact we desire, i.e. make reading a central focus of our practice in schools.

It’s only through talking through a problem like this with such a wide ranging group that such solutions can be generated.

Using outcomes to focus the planning process

 

We had a meeting on Friday where we looked further at how we could use outcomes as drivers of our new service improvement plan.

It was good to give this topic a significant amount of time and it looks like we are making progress.

We have agreed that each part of our plan will have:-

– an overall outcome, e.g. Every school will achieve a very good level of performance in Learning and Teaching. This replaces the aim or objective section.

– a desired impact, e.g. Children will experience a consistently high level of education. This is the “why are we doing this”

measurable outcomes, e.g. we will identify a range of outcomes which will relate to the overall outcome. It will be important that these outcomes are well balanced and possible to gather.

– the actions, e.g. develop learning teams in every school.  In the school’s version of this we will be less interested in the actions and maintain our focus upon the outcomes.  Hopefully this will free up some of the bureaucratic demands from which the planning process often suffers.

In the past the success criteria (OUTCOMES) came tagged on at the end of the planning process.  What we are proposing is that the process is actually driven by the outcome and desired impact.  I hope to have completed a draft version of our plan for general consideration by the middle of February.

We are replacing the National Priorities as the strcutural framework of the plan with the UN Conventions rights of the child: Safe and Nurtured; Achieving; Included; Healthy and Active; and Respected and Responsible. The example given above would fit within the Achieving dimension.

So much of this relates back to something I encountered last summer relating to Social Return on Investment.
